Covenants, Rules & Regulations
The rules & regulations herein contained were formulated by members of the Board of
Directors, the Rules and Regulations Committee and the York Property Manager. The guidelines that
were used by the Committee were taken from several existing condominium rules in the
Raleigh area. We wanted the rules to be few and well chosen with special consideration to
the outside aesthetic appearance as it relates to the value of our property. In most cases
uniformity was a central issue, as well as the rights of and respect for our neighbors and owners.
Guests of owners/occupants are subject to all rules and regulations.
The Covenants, Rules & Regulations are effective November 15, 2003.
I. Sale, Modifications & Purpose of Condominium Unit

An owner must notify the Management Company:
-
when the sale of his/her unit has occurred
-
of the name of the new owner
-
of the date on which ownership is transferred

No major alterations of a unit shall be undertaken without the approval of the Management Company, Board of Directors and its authorized architect. Major modifications include, but are not limited to, changes in the configuration of walls, plumbing, wiring, ventilation system or anything that may violate structural or aesthetic integrity or create a potential hazard. Failure to gain the necessary approvals can result in additional modifications or restoration of the unit to its original condition - all at the owner's expense.

No alterations to common areas or the building exterior may be made.

The unit is not to be used for purposes other than as a dwelling including, but not restricted to, commercial, educational, medical, public service, political or religious enterprises.
II. Lease of Condominium Unit

If you lease your unit, please be aware that you are still responsible for ensuring that your lessee receives and understands the rules & regulations of the Association prior to occupancy. Fines for non-compliance of the Founders Row Covenant, Rules & Regulations will be the owner's responsibility.

Any owner who plans to lease a unit must notify Nancy Richerson of York Management Company at nancyricherson@yorkproperties.com or 919.821.1350 of the name of the lessee and the effective date of occupancy. This notification must be made at least ten days prior to occupancy so that a copy of the Founders Row Covenant, Rules & Regulations can be furnished to the lessee by the Management Company. The owner is still responsible for ensuring that the lessee understands the rules & regulations of the Association.

If notification is not made ten days prior to occupancy it is the owners responsibility both to furnish the lessee with a copy of the Founders Row Covenant, Rules & Regulations and to ensure that the lessee understands the rules & regulations of the Association prior to occupancy.

A copy of the finalized lease agreement must be filed with the York Management Company.
III. Pets
Founders Row conforms to all Raleigh ordinances pertaining to pets. Furthermore,
for the health, safety and comfort of all residents, the following rules shall be observed
governing pets:

Generally recognized house pets, in reasonable number and size (less than 100 lbs), may be kept and maintained in a living unit, provided such pets are not kept or maintained for commercial purposes. Pet owners may apply for a waiver with the Founders Row Homeowners Association Board of Directors.

Pet owners must provide documentation indicating that each house pet's rabies vaccination is current.

Any household pet shall be kept on a leash while outside as set forth in the Wake County Leash Law. No animal may be leashed to any stationary object in common areas.

No dog shall be permitted to bark, howl or make other loud noises for such an unreasonable time as to disturb neighbors' rest or peaceful enjoyment of their unit or the common areas.

Pet owners or responsible parties (e.g., pet sitter) are responsible for removing their pet's wastes from the common area as set forth in the Raleigh City Code, Section 12-3011.

Pet owners are responsible for any property damage, injury, and disturbances caused by their pets. Pet owners will be billed an amount equal to the cost of having an area cleaned.
IV. Balconies, Patios, Common Areas & Roof Access
The balconies, patios, courtyards and mews are a prominent part of the structure of the
condominiums and therefore, need to be aesthetically appealing.

All gas, electric and charcoal grills are prohibited on balconies/patios, in all common areas and inside units. The only exception is that electric grills may be used in the kitchen under a stove hood. Violators will be subject to the penalties provided in the Raleigh City Charter and Code of Ordinance, Section 5-2042, in addition to Founders Row Homeowners Association sanctions.

One Founders Row Realtor Information Box will be used for properties for sale or rent. No additional real estate or other exterior signs shall be permitted on or about the Founders Row property.

One realtor lock box with a gate key will be located at the Davie Street front entrance gate closest to Person Street. Realtor lock boxes with keys to individual units will be attached to the front door of the unit for sale or rent. Lock boxes located on the Blount Street or Person Street side entrance gates or the Davie Street front entrance gates closest to Blount Street will be removed and discarded.

No common area shall be used for personal storage (e.g., firewood, boxes, bicycles, strollers or furniture).

Balconies and patios should be kept free of clutter and debris.

All exterior window screens on each unit shall be of uniform style and color consistent with the exterior window screens for all units. Window screens shall be maintained and installed at all times, unless the window is being cleaned or repaired.

Penetration of exterior stucco is prohibited. Owners are responsible for any damage to the exterior stucco or to common areas by themselves or their lessees (e.g., inserting nails or screws in stucco, refinishing furniture in corridors,). Owners will be billed an amount equal to the cost of having an area repaired.

Owners are responsible for any property damage at and around roof access (e.g., walls, stairwell) by themselves, their lessees or third parties during installation of roof equipment (e.g., air conditioning units). Owners or a representative must ensure that a ladder is present so that installers do not climb up walls and must be present while the unit is being maneuvered up the stairwells and through the roof access to ensure that there is no building damage. Owners may also be fined an amount equal to the cost of having an area repaired.
V. Parking

Parking at Founders Row is restricted to passenger automobiles, recreational sports vehicles, motorcycles, pick-up trucks and vans. All vehicles must weigh less than two tons and be no greater in area than a full size passenger vehicle. Parking of vehicles such as, but not limited to, jet skis, trailers, motor homes and boats are prohibited. Moving vans and service vehicles are exempt on a day-by-day basis.

Vehicles that are not operable and do not have current licenses and tags are not to be parked in the lot and will be tagged and given a ten 10-day notice before being towed at the owner's expense. Please file all towing information with the York Properties Management Company via e-mail at nancyricherson@yorkproperties.com.

Storage of items of any kind and for any duration is prohibited in the parking area.

Tampering with or holding either of the parking entrance gates open is prohibited.
VI. Trash and recycling

All glass, newspapers and broken down cardboard boxes must be placed in the recycling dumpster located at the Person Street entrance.

All trash must be bagged and placed in the dumpster located at the Person Street entrance.

Dumpsters are not to be used for the disposal of flammable, corrosive/poisonous materials or aerosol containers. Also prohibited is the discarding of construction waste such as wood, metal, drywall, paint, applicators, appliances, carpets or carpet pads.
VII. Noise
As we are a connected community who share walls, lessees and owners are asked to be conscious and mindful of their neighbors.

Consistent with the City of Raleigh's noise ordinance, residents and their guests must minimize noise between the hours of 11:00 p.m. and 7:00 a.m. Sunday through Friday and 12:00 midnight Saturdays to 12:00 noon Sundays. Excessive noise at any time should be settled between neighbors. If this is not possible, please call the Raleigh Police Department. A complaint may be filed with the association after these remedies have failed.

Fireworks and the carrying or discharging of firearms is prohibited.

Yard sales are not permitted within the confines of Founders Row Condominiums without prior approval from the Board of Directors.
VIII. Assessments
Homeowner's monthly assessment is to be paid by the 1st of each month. After the 10th a late penalty of $8.00 is incurred. Those past due for more than sixty days will be charged a late penalty of $15.00 per month until their payments are current and referred to the Attorney for collection. Please be advised that failure to pay the monthly assessments will result in a lien being filed against your property. There will be a $25.00 charge for checks returned to the Association for "Insufficient Funds." Monthly assessment checks should be made payable to Founders Row Homeowners Association and mailed to the lock box along with the coupon c/o York Properties, Inc., PO Box 1070, Charlotte NC 28201-1070.
IX. Enforcement

In order for the Covenants, Rules & Regulations to be effective, violations must be reported immediately to the York Management Company via e-mail at nancyricherson@yorkproperties.com or telephone at 821-1350. The person(s) reported to be in violation of a rule or regulation will be issued a warning that the violation must be corrected within ten (10) days of the notice. Violations of city ordinances or violations that pose imminent danger to people or property will require immediate action without warning or grace period.

If the violation for which the citation was issued is not corrected within ten (10) days, the Board will initiate legal action against the violator. Please be advised that any legal action will become a lien against your property, which may be foreclosed pursuant to Chapter 47C of the North Carolina General Statutes.
